Access to and use of this website is governed by the terms and conditions set out below, as well as by the legislation applicable in the Republic of Peru. Accordingly, all visits and all contracts and transactions carried out by a customer (hereinafter, the “User”) on this website, as well as their legal effects, shall be governed by these rules and subject to such legislation.
The terms and conditions contained herein shall form part of all acts and contracts executed or entered into through the offer and marketing systems available on this website, between the users of this website and Quimtia S.A., hereinafter referred to as “QUIMTIA”, as appropriate according to the meaning of the text.
1. User or Customer Registration
Registration by the User and acceptance of these Terms and Conditions shall be required for the purchase of products and services offered on this website. These Terms and Conditions shall be deemed known and accepted solely by virtue of registration, during which the User shall expressly confirm their knowledge and acceptance of these terms of use. QUIMTIA reserves the right to update and/or amend the Terms and Conditions detailed below at any time and without prior notice. For this reason, we recommend that Users review the Terms and Conditions before carrying out any transaction.
To register, the User must provide a valid email address, complete a form and provide the personal details requested. The User declares under oath that such information is accurate, precise and truthful. The User also undertakes to update the personal data provided during registration whenever necessary.
QUIMTIA shall not be responsible for the certainty, truthfulness or accuracy of the personal data provided by Users, as Users shall be solely responsible for such information. Consequently, the declaration made by Users upon registration shall be understood as a sworn declaration.
By registering, the User accepts, without reservation, all provisions contained in these Terms and Conditions governing access to and use of QUIMTIA’s website.
2. Confidential Password
The User assumes full responsibility for maintaining the confidentiality of their password registered on this website, as well as access through their Facebook or Google account, which allows them to make purchases, request services and obtain information.
Such passwords and access credentials are personal and their disclosure to third parties shall not create any liability for QUIMTIA or its related companies in the event of misuse.
The User account created upon registration must not include another person’s name or provide any personal information belonging to another individual with the intention of impersonating them. QUIMTIA reserves the right to take appropriate measures if the User attempts to impersonate another person.
If a User becomes aware that a third party has obtained and is using their password and personal account, they must immediately notify QUIMTIA.
QUIMTIA shall not be liable for any damage related to the disclosure of a User’s username or password, or for any use made by any person of such username or password.
QUIMTIA may request the change of a username and password where it considers that the account is no longer secure, or where a complaint or claim is received regarding a username that infringes third-party rights.

3. User Rights on this Website
The User shall enjoy all rights recognised under the Peruvian Civil Code and applicable consumer protection legislation in force in Peru, in addition to those granted under these Terms and Conditions.
The User shall have, at all times, the rights to access and rectify their personal data. Mere access to this website, where goods and services are offered, does not impose any obligation on the consumer unless they have accepted the conditions offered by the company in the manner established in these Terms and Conditions.
Likewise, the User must take into account the scope of all regulations issued within the framework of the State of Emergency and their respective period of application.
QUIMTIA’s services are available only to persons capable of entering into legally binding contracts in accordance with applicable law. By accessing QUIMTIA’s website, the User declares that they are over 18 years of age and legally capable of assuming binding obligations regarding any responsibility arising from the use of QUIMTIA’s products and/or services.
Any actions carried out on QUIMTIA’s website by minors shall be the responsibility of their parents, guardians or legal representatives.
The User undertakes to use QUIMTIA’s services in accordance with the law, these Terms and Conditions, morality, good customs and public order.
The User agrees not to use QUIMTIA’s website for unlawful purposes or purposes contrary to these Terms and Conditions, harmful to the interests or rights of third parties, or which may in any way damage, disable, impair the platform or prevent other Users from making normal use of QUIMTIA’s services.
The User expressly undertakes not to destroy, alter, disable or otherwise damage the data, programmes, electronic documents or any other materials contained on QUIMTIA’s website.
The User undertakes not to obstruct access by other Users through excessive consumption of the computer resources used by QUIMTIA to provide its services, nor to carry out actions that damage, interrupt or cause errors on QUIMTIA’s website.
The User undertakes not to attempt to penetrate or test the vulnerability of any QUIMTIA system or network, nor to breach its security or authentication measures.
QUIMTIA reserves the right to determine, at its sole discretion, when any of the obligations described above have been breached.
If a User breaches the provisions of this section, QUIMTIA may take one or more of the following actions depending on the seriousness or recurrence of the breach:
- Warning the User.
- Temporarily suspending the User’s account.
- Permanently cancelling the User’s account.
- Initiating civil or criminal liability proceedings.
4. Procedure for Using this Website
For products offered through this website, QUIMTIA shall clearly and easily provide information on the steps required to complete a purchase and shall notify the User by email when the order request has been received.
This request shall undergo a process involving validation of the User’s details, payment method and collection of the products included in the order based on stock availability on the dispatch date. The order shall then be completed, and the payment receipt shall be issued and sent to the User after delivery of the order or by email once the order has been invoiced.
QUIMTIA shall also provide its postal or email address and the technical means available to consumers to identify and correct errors in submissions or personal data.
5. Payment Methods Available on this Website
Products and services offered on this website, unless otherwise indicated for specific cases or particular offers, may only be paid for using the following method:
Online payments using credit or debit cards:
We accept Visa, MasterCard, American Express and Diners credit cards. Approved amounts shall be withheld or charged to the card used at the time of purchase.
After delivery of the order, and where the order is incomplete due to the unavailability of one or more products, the refund process for the difference shall be initiated to the payment method used for the purchase, subject to the deadlines established by the relevant financial institution.
Payment using a bank debit card is subject to the Terms and Conditions established by the issuing bank.

Payment deadlines:
At the end of the purchase process, the Customer must make payment using the bank account details displayed on the website. Payment may be made through online/mobile banking or bank branches.
This payment option shall remain valid for seventy-two (72) hours to complete the payment process. The Customer must make payment within this period; otherwise, the order created shall be automatically cancelled and the purchase process must be completed again.
Once payment has been made, the Customer must provide the transfer or transaction reference number in the orders section or send proof of payment by email to contacto.peru@quimtia.com.
Once the payment information has been received, QUIMTIA shall validate the information and, if accepted, proceed with the order delivery process.
Delivery deadlines:
Delivery shall be scheduled for the earliest possible date, subject to the following considerations:
For orders within Metropolitan Lima, delivery shall take place on the next working day, provided that payment is made and validated by QUIMTIA from Monday to Friday before 2:00 pm.
For orders to provinces, delivery times shall be calculated from the date on which payment is made and validated by QUIMTIA, according to the delivery times by destination shown on the website before completing the order request.
